STATE DROPS CASE AGAINST JOURNALIST SHERRI KANE
PRAYERS WORKED: STATE DROPS CASE AND LEARNS LESSONS FROM JOURNALIST SHERRI KANE’S HEROIC ACTIONS
Honolulu, HI (Oct. 9, 2013)—International prayers worked for journalist Sherri Kane as the State of Hawaii surprisingly dropped its criminal case against the activist who was assaulted and then falsely arrested by security guards for allegedly “obstructing governmental operations” while investigating and videotaping violations of homeowners’ Constitutional rights by banks, lawyers, and judges.
From Christian evangelists to Reike masters, hundreds of supporters worldwide prayed, many after telephoning and e-mailing encouragement to Kane—the victim of security officers’ use of excessive force after judge Bert I. Ayabe ordered her removal from the court for recording First Amendment violations linked to America’s economic collapse and widespread foreclosure fraud.
“I want to thank all the wonderful people who prayed for us; who called to encourage me, and told us not to worry because righteousness always prevails,” Kane said.
Kane and her partner, Dr. Leonard Horowitz, arrived in court yesterday morning expecting to see Kane’s name on a roster of defendants summoned by the State for crimes. But nowhere was her name to be found.
After nearly an hour of investigating, Kane’s attorney learned the case had been dropped by the “higher-ups.”
“Officials simply disappeared the case,” Horowitz said, thrilled by the unexpected reprieve.
“We fully anticipated moving to trial after Sherri’s pleading of ‘not guilty.’ To our joy and amazement, the charges against her vaporized. The State is even going to refund her bail.”
Kane’s attorney was also surprised by the matter’s instant disappearance. He explained that he had made several inquiries at the sheriffs’ department, and the prosecutors’ office, and learned that many officials were disturbed by Kane’s assault and unwarranted arrest. Supreme Court officials, he learned, had considered the matter evolving into a “media circus,” shaming the judicial system. “This is something they did not need,” the lawyer confessed.
So the State’s complaint against Kane instantly vanished.
Kane’s video recording now playing on Vimeo’s Revolution Television, stops at the moment she was manhandled by two deputy sheriffs after judge Ayabe—Barack Obama’s chief protector denying the media’s access to the infamous “Birth Certificate”— ordered them to “Remove her!” The film shows the officers evading her question–What law authorizes the court to block a member of the Free Press from silently and unobtrusively video recording evidence from the gallery?
Kane and Horowitz were gathering video evidence of alleged racketeering activities administered by lawyers and judges complicit with Big Banks damaging homeowners by fraudulent foreclosures.
“I wasn’t ‘obstructing government operations,’” Kane said about her alleged misdemeanor. “I was defending lawful government operations by exercising my Constitutional duty as a journalist recording a crime that evades exposure, skirts questions of law, and authorizes damaging acts of censorship and discrimination for profit. I was gathering video evidence for research in the pubic interest. So, I was dutifully securing proper governmental operations.”
Ayabe drew everyone’s attention to Horowitz and Kane the moment Anthony Williams, a common law revolutionary, challenged the judge’s authority, lawyer “licensing,” and the court’s jurisdiction. Panicked by prospects of the video going public, Ayabe is suddenly heard ordering Horowitz to stop recording. Minutes later, the judge violated Kane’s First Amendment Free Press rights, and arguably broke Hawaii’s evidence tampering law, HRS §710-1076, because the couple were filming the history-making scene likely to be used in pending lawsuits promised by Williams.
A week after Kane’s assault and false arrest, Williams was imprisoned on false “child molestation” charges.
Williams is featured in “The HOROKANE’s” video series titled Outlaws-in-Justice. He was arguing that Ayabe was defrauding the court by claiming Williams was “practicing law without a license” and violating foreclosure victims’ civil rights. The “Private Attorney General” argued before a number of courts in recent weeks before his arrest, that citizens were not being given a fair trial before their homes were taken by banks that issued predatory mortgages and committed securities fraud by “robo-signing” promissory notes without the borrowers’ authorization.
“Our purpose in being in that court was to document these unprecedented events, and facilitate ‘justice-for-all,’” Horowitz said.
Kane is considering filing a complaint against the sheriffs and judge Ayabe for breaking their oaths of office, for Federal civil rights violations, and for neglecting their duties to enforce State statutes. Her decision depends mainly on the State continuing to “do the right thing.”
“There are two important lessons to be learned from this besides the power of prayer and public righteousness in administering justice,” Dr. Horowitz said. “The first compels the Supreme Court of Hawaii, and all courts nationwide, to modernize their Rules 5.1 and 5.2 that were made long before the consumer electronics communications era that has enabled everyone with a cell phone or tiny video camera to serve as members of the ‘free press’ by quietly recording hearings and government operations of social importance. These rules must be updated to secure First Amendment freedoms in defeating corruption in our judicial system; in other words, to clean up the courts.”
“The second lesson,” Kane addressed immediately after being hospitalized for her assault by officers D. Yanagi and K. Kim. “Their lack of training in civilly escorting their victims out of the courtroom is a glaring hypocrisy in the ‘Department of Public Safety.’ If you let ignorant ogres like this get away with assaulting women a fraction of their size and weight, they are sure to become repeat offenders.”
Consequently, the journalists are calling on their supporters and the Supreme Court of Hawaii to address these two matters to defend our judicial system against fascism.
